These Terms represent the entire agreement between you and Artina Promotional Products regarding the use of our Site and services and supersede all prior communications or agreements.
17. Governing Law
These Terms shall be governed and interpreted in accordance with the laws of the State of Ohio, United States, without regard to conflict of law principles. Any legal action or proceeding must be brought in a state or federal court located in Ohio, and you consent to the personal jurisdiction of those courts.
CONCLUSION
While Ohio does not currently have broad consumer privacy laws, general U.S. laws still apply. I have added additional language to the Privacy Policy which addresses and complies with federal privacy laws such as COPPA for children, CAN-SPAM for marketing emails and the FTC’s general consumer protection rules. The Ohio Data Protection Act of 2018 gives companies a legal safe harbor if they maintain a written cybersecurity program that reasonably conforms to recognized standards. While it doesn’t mandate a privacy policy, having one shows good faith compliance. Please update any sections to include Artina specific information.
Unlike the Privacy Policy which deals with data, the Terms & Conditions are the legal contract between the website and its users. Ohio does not have special Terms & Conditions laws but should instead be based and subject to Ohio contract law. To make the terms enforceable your website creator should make them clearly visible on your site (usually in the footer) and should require users to affirmatively agree to them if they are creating accounts, making purchases or providing sensitive data. Please update any sections to include Artina specific information.
